Estate planning is an integral part of business succession planning. I am commonly asked what are the most common problems encountered in estate planning trusts.  There are so many problems with trust administration it is difficult to find a place to start or where to stop.  For lack of a better plan, let’s consider what I have found to be the top five trust administration problems:

Distributions of assets are often faced with much dilemma. Primarily because in wealthy families, those assets translate to majority of stocks in the corporations, hectares of land and considerable amount of money. Family members are often skeptical of the trustee especially if the provisions of the will have been hidden from them for a long time. I agree that wills should have a room for amendments to accommodate any problem that would arise.

Wills are often prepared by estate lawyers. In Ottawa and in other states, such individuals are recognized by the State to represent the deceased and distribute his assets. Estate lawyers (Ottawa and other locations) often read the will and respond to questions based on the provisions set by the deceased.
